SMS Terms

This is starter content that states EMBER’s text-message program as it is set up today. No published SMS Terms document exists in Sanity yet, so this is editable now from the Studio and is pending review by EMBER’s counsel. Texting is not switched on: no message has been sent and the application’s text-message box is not offered until it is.

This document is starter content that describes how EMBER and this website operate today. It is provided so the pages are complete and editable from the outset, and it is pending review by EMBER’s legal counsel before it is relied upon as the club’s binding agreement. Sections that require legal judgment are marked accordingly.

1. Who sends the messages

EMBER, the private membership club in Minneapolis, sends them. Nobody else sends on our behalf and nobody else sends using your number. Twilio carries them for us.

EMBER to confirm. Which number will EMBER text from once the A2P campaign is approved? CTIA 5.1.1(2) asks the call-to-action to name the originating number. The page cannot name it yet.

EMBER to confirm. What is the legal name of the company that should appear on the privacy policy and the SMS terms - 'EMBER', or the registered entity behind it? Both pages say 'EMBER', which is the brand. A carrier and a data-subject request both need the entity.

2. What we send

Only club business. There are four kinds:

  • News about your application, while it is with us.
  • Invitations to EMBER events.
  • RSVP replies and reminders for an event you said yes to.
  • Check-in messages on the night of an event.

We do not text you advertising for anyone else, and we never text on behalf of another company.

3. How often

Message frequency varies. It follows the club’s calendar: quiet between events, more in the week of one, and a short run of messages while your application is being read.

EMBER to confirm. Roughly how many texts should a member expect in a month - is 'up to 4 a month' right, or more during an event week? CTIA 5.1.2.1(4) asks for the frequency, not only that it varies. 'Message frequency varies' is the standing wording until you set a number.

4. What it costs

EMBER does not charge you for text messages. Message and data rates may apply - that is between you and your mobile carrier, and it depends on your plan.

5. Stopping them

Reply STOP to any message from us. That stops them, and we will send one last message confirming it and then nothing more.

STOP is the word to use, but you do not have to be precise: END, QUIT, CANCEL, UNSUBSCRIBE, or simply asking us to stop, will all be read and acted on. Capital letters do not matter.

You can also just ask us - by email, on the phone, or at the club. It does not have to be a text.

6. Getting help

Reply HELP to any message from us and we will reply with how to reach a person.

EMBER to confirm. What email address or phone number should a HELP reply give out for text-message support? HELP has to return support contact information (CTIA 5.1.3 and 5.1.2.1(2)). Today it has nothing to return.

7. How you say yes, and how you take it back

You say yes by ticking the text-message box on the EMBER membership application. The box is unticked when you get there, and it stays unticked unless you tick it. We keep what you ticked, the exact wording you agreed to, and when.

Ticking it is not a condition of applying, and not a condition of membership. Giving us your mobile number on a form is not the same as ticking the box - we do not text a number that was given to us for any other reason.

Your consent covers EMBER’s messages and only EMBER’s messages. We cannot pass it to anyone else and we would not.

To take it back, reply STOP, or ask us in any of the ways in section 5.

8. Your number

EMBER does not share, sell, rent, or provide your mobile phone number, your mobile information, or your text-message consent to third parties or affiliates for marketing or promotional purposes at any time.

What we do with it otherwise, how long we keep the record, and how to ask for a copy or a deletion, is in the Privacy Policy.

9. Delivery

Messages are carried by mobile networks we do not control, so we cannot promise one arrives, or arrives on time. Mobile carriers are not liable to you for a message of ours that is delayed or never turns up.

10. Contact

11. Changes

If we change these terms, the effective date at the top changes with them, and the version here is always the one in force. A change that affects what you agreed to will be sent to you before it takes effect.
